What does Perjanjian Kerja Waktu Tidak Tertentu (PKWTT) mean?
Perjanjian Kerja Waktu Tidak Tertentu, usually shortened to PKWTT, is an Indonesian indefinite-term employment agreement. It is commonly understood as the contract type used for permanent employment.
Unlike PKWT, which is fixed-term and linked to a period or completion of specific work, PKWTT does not have a fixed end date. The employee is hired on an ongoing basis, subject to the employment contract, company policy, and Indonesian employment rules.
Indonesia’s labour framework recognises employment relationships and employment protections under Law No. 13 of 2003 on Manpower, as amended by later regulations. For employers, PKWTT should be treated as a long-term employment structure, not just a contract label.
Why PKWTT matters for employers
PKWTT matters because many ongoing roles should be structured as indefinite-term employment rather than repeated fixed-term contracts. This may include roles in finance, operations, customer support, marketing, HR administration, software development, or management where the work is expected to continue.
For employers hiring in Indonesia, PKWTT affects more than the employment agreement. It connects to payroll, BPJS Kesehatan, BPJS Ketenagakerjaan, PPh 21, THR, leave, payslips, employee records, performance management, and termination planning.
A business hiring from Singapore or any other market should not assume that its home-country permanent contract template can be used directly in Indonesia. The contract should reflect Indonesian employment terminology, statutory benefits, payroll items, and local employment practices.
If the business does not have an Indonesian entity, Weshine’s Employer of Record service can support local employment setup, payroll, and statutory benefit administration for employees in Indonesia.
PKWTT vs PKWT
Note: Employers should choose the contract type based on the nature of the role and the actual working relationship. Local review is important because the wrong contract structure can create compliance and termination risk.
Common mistakes employers should avoid
A common mistake is avoiding PKWTT only because the employer wants flexibility. If the role is ongoing and the worker functions as a regular employee, PKWTT may be the more appropriate structure.
Another mistake is treating PKWTT as only a simple permanent contract. Employers still need to manage proper payroll, statutory contributions, employment records, leave, performance documentation, and final pay or termination obligations where applicable.
Employers should also avoid using a foreign employment contract without localising it. Indonesia-specific terms such as BPJS, THR, PPh 21, PKWT, PKWTT, notice, and termination treatment should be reviewed before the contract is issued.
